Please read these Terms of Service ("Terms") carefully. By accessing or using policyhosting.com (the "Service"), you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 16 years old and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

PolicyHosting allows you to generate, host, and update privacy policy documents at a permanent URL for use with mobile app stores, websites, and developer accounts (including Meta, Google Play, and Apple). The Service offers subscription plans at different tiers.

3. Your Account

  • You are responsible for safeguarding your password and for any activity that occurs under your account.
  • You must provide a valid email address and verify it before using the Service.
  • You must notify us immediately of any unauthorized access or security breach.

4. Acceptable Use

You agree NOT to:

  • Generate or host privacy policies that contain illegal, fraudulent, or deceptive content
  • Use the Service to impersonate another person, business, or app
  • Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service
  • Use the Service to send unsolicited communications, spam, or malware
  • Resell, sublicense, or redistribute the Service without our written permission
  • Scrape, crawl, or systematically download content from the Service beyond your own policies
  • Violate any applicable law or regulation in your use of the Service

We may suspend or terminate accounts that violate these rules.

5. Subscriptions and Payments

  • Paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on the plan you choose).
  • All fees are non-refundable except where required by law.
  • We may change subscription prices with at least 30 days' notice; changes apply to the next billing cycle.
  • Subscriptions auto-renew unless you cancel before the renewal date.
  • If payment fails and is not corrected within a reasonable time, we may downgrade or terminate your subscription.

6. Cancellation and Termination

  • You may cancel your subscription at any time from your account dashboard.
  • After cancellation, your published policies will remain accessible for the remainder of your paid term (up to 1 year from your last payment), after which the URLs will be taken down.
  • We may suspend or terminate your account at any time for violation of these Terms or for any reason with reasonable notice.
  • You may delete your account at any time; deletion removes your account data and any published policies.

7. Your Content

You retain ownership of the content you create (the privacy policies, app names, descriptions, etc.). By publishing content on the Service, you grant us a limited, non-exclusive license to host, display, and distribute that content as necessary to provide the Service. We do not claim ownership of your published policies.

8. Our Intellectual Property

The Service itself — including the website design, templates, source code, branding, and documentation — is owned by PolicyHosting and protected by copyright, trademark, and other laws. You may not copy, modify, or create derivative works from the Service without our written permission.

9. Not Legal Advice

THE TEMPLATES, GENERATED POLICIES, AND ANY CONTENT PROVIDED BY THE SERVICE DO NOT CONSTITUTE LEGAL ADVICE. We are not a law firm. The Service is a self-help tool. If you need legal advice for your specific situation, consult a licensed attorney.

You are solely responsible for ensuring that any policy you generate or publish is accurate, complete, and compliant with the laws applicable to you and your users.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING (BUT NOT LIMITED TO) MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCEPTED BY ANY THIRD PARTY (INCLUDING APP STORES).

We do not guarantee that policies generated through the Service will be accepted by Meta, Google, Apple, or any other platform.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLICYHOSTING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless PolicyHosting, its officers, directors, employees, and contractors from any claim, loss, or expense (including reasonable attorney fees) arising from: (a) your use of the Service; (b) your published content; (c) your violation of these Terms; or (d) your violation of any third-party right.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms at this URL and update the "Last Updated" date. For material changes, we will notify active account holders by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law provisions. Any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction in those courts.
